Scope: These Terms and Conditions apply to all offers, orders and services provided by Thecarchecker (Manuel Schmid) in the field of photo and video production as well as related services. Offers & Conclusion of Contract: • Offers are non-binding and valid for 30 days from the offer date. • The contract is concluded by written order confirmation; confirmation by e-mail is sufficient. • Changes or additions require written agreement. Services & Prices: • The scope of services is based on the respective offer. • Additional services and third-party costs, such as travel expenses, locations, models or equipment rental, that are not included in the offer will be charged separately. • Unless otherwise stated, all prices are in CHF. Payment Terms: • Unless otherwise agreed: • 50% deposit upon order confirmation • 50% final payment after project completion • Payment term: 10 days net • In the event of late payment, default interest and reminder fees may be charged. Dates & Cancellation Fee: • Agreed dates are binding. • In the event of cancellation by the client, the following conditions apply: • From 48 hours (2 days) before the start of the shoot: • 50% of the agreed fee • From 24 hours (1 day) before the start of the shoot: • 100% of the agreed fee • 100% of any incurred third-party costs • In the event of earlier cancellations, an appropriate share may be charged if services have already been provided. Execution & Client Cooperation: • The client ensures that all necessary information, access and approvals are provided in good time. • Delays caused by missing cooperation may lead to rescheduling or additional costs. Usage Rights: • Usage rights for image and video material are transferred only after full payment has been received. • Unless expressly agreed otherwise, the following applies: • Use for the purposes defined in the offer, such as website or social media • Further use, such as paid campaigns or transfer to third parties, requires an additional agreement. Copyright & Reference Use: • All created content remains the copyrighted property of TheCarChecker. • TheCarChecker is entitled to use the created material for self-promotion, including website, social media and portfolio use, unless otherwise agreed. Liability: • TheCarChecker is only liable for damages caused by gross negligence or intent. • No liability is accepted for technical failures, force majeure or unforeseeable circumstances. • Liability for indirect damages or loss of profit is excluded. Data & Archiving: • Raw data, including RAW files, is not provided as standard. • Data is archived without guarantee and for a limited period of time.
